I know that the "social progressives" out there, and even perhaps some "ultra conservatives" are going to have their panties all up in a wad about this, but for those that believe that protecting the country from potential terror strikes is something of paramount importance, this is relatively good news.
Despite the ruling of a lower court, which was apparently "reaching" to find the conclusion they did, Jose Padilla will remain in custody thanks to the ruling of an appeals court.

RICHMOND, Va. - A federal appeals court Friday sided with the Bush administration and reversed a judge’s order that the government either charge or free “dirty bomb” suspect Jose Padilla.
The three-judge panel of the 4th U.S. Circuit Court of Appeals ruled unanimously that the president has the authority to detain a U.S. citizen closely associated with al-Qaida.
“The exceedingly important question before us is whether the President of the United States possesses the authority to detain militarily a citizen of this country who is closely associated with al Qaeda, an entity with which the United States is at war,” Judge Michael Luttig wrote. “We conclude that the president does possess such authority.”
Ooops, that last conclusion may cost Luttig a seat on the Supreme Court! I'm sure the liberals are all set and ready to hold that one against him if he is ever nominated for such a seat.
And even worse, it seems that court is confirming the President has extraordinary powers in this area. Heaven forbid, the constitution must be literally disintegrating around us. Look out everyone, protect your rights while you still can!!! The gub-ment is coming to take them from you. Watch your friends as they get drug away in the middle of the nite and never contact anyone again. It's all part of the big conspiracy so that Bush can get more oil wherever he can find it at!
