Another reason not to give terrorists lawyers

BERLIN, Germany -- Germany's high court has ordered the release of a Syrian-born German man whom Spain wanted extradited in connection with the 2003 Madrid bombings.

Yes. Terrible to see an adversarial justice system acting exactly as it was designed to act. Perhaps it would have been better if they'd simply shot him in the head as soon as he was caught.

In any event I doubt it will be long before he's safely in custody again. If he's stupid enough to get caught once then it'll happen again.

It's not the justice system itself. It's bringing these people to an open court in the first place. This man is a dangerous terrorist. What do people think he's going to do, go back to a simple life of peace? Releasing this man will cause more people to be killed.

In which case it has nothing to do with the lawyers at all. They are deceitful because that is a requirement of the system. If you need a closed court to charge what is, after all, just a criminal with delusions of grandeur, then really you've already lost because you're embracing the tyranny which they claim is natural to us.

I say give them open trials with lawyers and all the trimmings. If they're guilty they'll be punished by their peers, as is proper and just. If they're not they'll go free. And if they are found guilty and are let out after serving their time, then that is just and should happen. They are criminals, nothing more and nothing less. To treat them any different to criminals is to accept that their claims have a legitimacy which frankly I don't believe they deserve.

I guess to some people, the future of war is an endless line of enemy combatants moving from the battlefield to the courtroom.

I guess Miranda rights and other proper arrest procedures needs to be added to Military Basic Training. I wonder, should those blocks of instruction be scheduled just before, or just after Sensitivity training and proper handling of the Holy Qur'an? ;~D

Wasn't this guy picked up in Germany to begin with? Which has yet to declare war on terror, and is thus considering it more a crime for police and internal security to deal with than soldiers?

I dislike the idea of soldiers performing police duties as much as perhaps you do ParaTed, so I don't know what you're getting at here. What do soldiers learning Miranda rights have to do with a Syrian-born terrorist caught in Germany and then released after serving his time?

Are you suggesting that he should have been gunned down by soldiers on the streets of Berlin or something? I don't think the people who live there would enjoy catching stray rounds, even if 'the enemy' was occupying a square foot of German soil in the name of Islam.

Terrorists aren't soldiers. They don't operate like them, they don't supply like them, they don't fight like them. And the sooner they cease to be treated like them, and are treated like the criminal civilians they are, the quicker they'll be dealt with. You can't simply equate the rest of the world with Iraq or Afghanistan because frankly I think there's a world of difference between say, New York and Baghdad, or Sydney and Kabul, or even Jakarta and Kabul for that matter. Why should it be necessary to treat terrorists as soldiers and roll tanks through otherwise peaceful streets when it's far more likely police work and the police themselves will hold all the aces in catching terrorists?

Surely that's a waste of time and resources! I never knew that was what you believed necessary to secure a peaceful western nation! God forbid you ever get into power! ;~D

Cacto, I don't think the bacteria should be treated like soldiers, but then again they shouldn't be treated like criminals either. The bacteria are nothing more than mercenaries. The Geneva Convention specifically omits mercenaries from its protections.

To the bacteria, borders, local laws, or anything else doesn't matter. They will kill another Muslim as easily as they would kill you or I. No, I don't expect shootouts in every neighborhood because of this any more than I expect shootouts in every neighborhood in any war. True, the primary battlefields right now are Iraq and Afghanistan, but the bacteria has made if very clear that those are our battlefields, not theirs. Their battlefield is any target of oportunity that ilicites a high visibility reaction.

As we have seen, Terror knows no borders. The French Frenchified Germany after the war. The only thing they did not export to Germany was the bad manners and atrocious behavoir.
