A Supreme Fight

For too long the Justices on the Supreme Court's motto has been "I'll give up my robe when you can tear it away from my cold, dead, decrepit body". It has indeed looked more like the Supreme Convalescent Center.

Justice Sandra Day O’Connor announced her resignation. Soon Chief Justice William Rehnquist will do the same. This gives president Bush a chance to shape the court for many years to come. The Rehnquist vacancy would not be as critical because we would only be trading a conservative with another conservative, but the O’Connor vacancy is entirely different and will effect the balance of the court.

When Ronald Reagan appointed her, Sandra Day O’Connor was decisively conservative. Her early rulings reflected this and continued through most of her career. Except for a few noteworthy exceptions on abortion, she has been in the conservative camp. Then came the 2000 Presidential election and the much-celebrated Supreme Court Decision overruling the rogue Florida's Supreme Courts attempt to steal the election for Algore. Ever since then Justice O’Connor has attempted to make amends to the left for that decision. She has sided with the left side of the Court on almost every important case. The left knows how delicate the balance is right now. They will stop at nothing to keep even a moderately conservative off the bench. This will most likely make the Clarence Thomas fights seem like a minor scrap in comparison. The Democrats have made a critical mistake however. By fighting so hard against lower court nominees they have may have played all their cards. This may give the Republicans the excuse to use the Constitutional option to end filibusters of judicial nominees. Hopefully the Republicans in the Senate will show their backbone. Unfortunately with our current Republican majority, being full of moderates and RINO's I am not particularly hopeful. They must be up to the fight however because the left will use their own version of the nuclear option. They will spare nothing to keep a conservative from replacing Sandra Day O’Connor. The Supreme Court is the lefts only haven.

President Bush must resist making his fathers mistake. He must not nominate someone like David Souder. Bush needs to hit the Democrats head on and fight for his life. He has a majority, so he needs to use it. This vacancy especially is the most important in decades. Our countries future is at stake. The court already has 4 staunch liberals who will die before they retire. There are only 3 good conservatives. The other two Kennedy and O’Connor are the swing votes. We cannot lose this one to the liberals or else they will have an insurmountable five on the court. President Bush and the Republicans cannot let this happen.
