While I feel for the lady involved in this case, I'm amazed that a Federal Appeals court made up of the members as noted in the quoted portion of the article, was able to arrive at this conclusion, especially considering the district they work in.
I may not like micro-management by employers, but employers have rights to set standards, and employees have to meet them. If the employee didn't like the standards, she should have discussed it with her superiors and worked towards a compromise. If that wouldn't work, then she could exercise her right to find a new job elsewhere, without such standards in place.
