Ships being deleted and banned

The ships were removed for being likely copies (with slight modifications) made of Airmaster and Omnibus' ship designs on the steam workshop.

You used mine and Omni's and Modified the original designs and then taking credit for the original designs Omni and I created.

I own copyright to the custom ships I create for this game and I have the right to say who may and may not use them. They are only on workshop to share for players PERSONAL USE. You have no granted rights to use other players original created custom and redistribute it or other wise take credit for the original design you used and modified but you did not originally make for the game.

You NEVER contacted me to ask for my consent basically amounts to stealing and taking credit for my work which is a DMCA copyright infringement violation. Several of which both Omni and I have filed against your Steam account. Also this is  NOT the first time you have done this! I have had past problems with you doing this going back to 2017.

You put your ships out there for people to use. I use them with modifications that I like for my Races. But I leave The creators and where it was put as the creator of that ship. It is the only way that I know how to get your ship to come up only for my race instead of all the other crappy ships out there. It is a compliment to you the creator that I choose your ship to use with my races. Maybe one maybe all 3 of my races. Sometimes I even remember to put in the description that I am not the original creator and that it is a copied and modified versions of the original creator with their name as the creator.

I in no way ever intend to make others believe I created all of the ships I have in my 3 races.  I don't give a damm who thinks I created what I did create. Anyone can use what ever I created, modified or not for the game. I just like playing the game.

If I picked your ship it means You did a damm good job in creating it. Be prod of your work. But don't penalize other gamer's for using the great work you have done.

also I have written stardock about leaving the ship category section blank so players don't get the game style crap ships and start bases the game comes with. So this would allow other players to pick and choose your ships as the ones they want to use to come up with their races colors without having to upload a version of your ships. The game is flawed. Not my reasoning. Also the ship you are talking about here I put a center tail fin in the back and a new pilot seat in the front so it looked better with the colors of this particular race. Please understand that there are so many of us that just play the game  not to design ships, but just to play the game. You are a good designer I as a former designer of cars and trucks know a great design when I see one.

 Please in the future mark your ships personal so no one will be able to see or use your ship designs. We other gamer's will not like it, but se' la vie

Regardless whether or not my names are on them I created it, I OWN IT and I never gave you my permission to alter it and/or redistribute on your workshop without my consent.

There is no Kudos or Fame to be had from being the target of Copyright Theft.  Although there is a saying "Imitation is the sincerest form of flattery" it certainly does NOT condone the unlawful use and redistribution of an original artist's property.

Copyright can ONLY be relinquished by, or granted to others by the original author/artist.

Your redistribution of another's work removes that person from the control of his work.  With OR WITHOUT named credit it is still Piracy.

Artists will and do publish their work for others to use, but that is PERSONAL use. Re-uploading anothers' work, with or without modification constitutes PUBLIC Use.  It is the creation of a 'copy', and that is the same word 'copy' as in 'copyright' ... the right to copy - belongs to the owner/author/artist unless he/she states otherwise.

You have to file with the patent office to get a copyright for your ships. You do not just say they are copyrighted. Learn the laww.

Look, there is no way out of this. Just accept it and be on your way. You're trying to claim something you didn't originally make. If you didn't try to redistribute/publish it on Steam Workshop then it would be fine. Hell, if you set it as a private for your own usage then it not going to be any problem. You put it up on Workshop in public mean you're claiming to be the owner of it even thought you aren't.

There is a difference between sharing and redistribute. What you did was redistribute AirMaster, and Omni's ship design under your own name in the Steam Workshop.

Copyright is automatic with the creation of a work.  Lawyers will say they like a Copyright to be registered, but that is PURELY to save them work [proof], nothing else.

Now here's the reality.  I am now retired as an Architect after 46 years of Practice....that's 46 years of dealing with Copyright....and have gone head-to-head with lawyers who THOUGHT they new the Law.  They didn't....and I won the 'argument'.

Specifically, also since 2001 I have on many occasions fought online arguments about Copyright and its theft on behalf of others on Stardock's sites [plural] and haven't worried about International boundaries getting in the way....some of it has been in Norway and Russia, for example.  OK, the language made things 'interesting', but the result was the same.

Where the Law of Copyright is acknowledged there is essentially no difference in its policing.

Perhaps it is time for you to 'Learn the laww' [sic]....;)

Lets face it, you got caught breaking Steams rules and breaking the law. Legal action was taken against you on mine and Omni's behalf. Fact of the matter is you broke the rules and the law and ignorance is no excuse.

Fact of the matter is that Air master did not create those ships.  Air master used the parts supplied by the games Galactic 1,2,and three. none of the parts of those ships which are copyrighted belonged to him/her. They belong to the game producer and he would be in violation of U.S. law for claiming the collection of game supplied parts as his own design. A matter well documented in the courts by General Motors, Ford, and Chrysler when designers and engineers were trying to take out patents on items they designed while being employed by the big three. Air master di NOT silly the original intellectual property, Airmaster did NOT mark the ships as invisable. Airmaster did Not mark the ships as just for friends or family. Airmaster uploaded all those ships as visible to anyone on stem playing the game leading all other players to believe those ships could be used for their races ships. If airmaster did not want those ships to be used by other players then he/she should have used the proper checked boxes when uploading his/her ship files. When other players selet ships from the selection, they are not given the information on the creator or that ship and if it is not for use by all then it should have been marked so it would never have appeared when other players were looking for a new ship while in design a ship mode using an already designed ship or a new ship style. I did NOT violate any copyright laws, game wise or world. It would behoove airmaster to know the laws before he/she start making accusations that can get he/she sued for slander.

Once again you show just how ignorant you really are. 

Anything I create from scratch for this game, regardless that I used the tools provided to create the designs, yes, I own the copyrights to designs I created using the games ship designer.

You are really showing just how dumb you actually are not knowing the difference between the right to share a copy by original creator and third party redistribution without permission or consent. The laws are clear on this.

By this logic, architects wouldn't be able to hold onto their own designs either, as the actual parts themselves are provided by lumber and concrete companies. They also would probably be paid far less than they are now, for what it's worth.

I don't know Airmaster even a little bit, but the level of attention to detail in the ships that I have downloaded from him leads me to believe that he would remember if he hired you to design additional ships. I've used a great many of his and Omnibus's ships in my personal civs and it has always been very clear to me that I am appropriating them for my personal enjoyment only.

The whole point of uploading ships is for others to enjoy, however that enjoyment has limits just like everything else. In this case, the limit is between the point of modifying downloaded designs (which is allowed for personal use) and uploading those modified designs as a new creation. The most direct comparison that I can think of is when writing a persuasive essay. It is generally recognized that taking another person's argument and changing a handful of words does not constitute a new position, whereas having a very similar but distinct point of view is a valid mode of reasoning. If you had, in fact, created those designs using a similar method, there would likely be signs in the positioning of some pieces that showed you started from scratch. Since a developer came into the thread and presented examples (kudos for that by the way, I don't think very many companies would have the courage to allow that) I'm inclined to believe they had additional evidence that shows just how exactly many of those pieces line up (even without the confession in Reply #3)

I'm a pretty nice guy, and I'm fairly sure this started out as a misunderstanding of the terms of the Workshop, but you did yourself no favors by coming here and demanding things be put back in an open forum in the way that you did. I honestly chuckled when I read the whole post and then saw the signature "Respectfully" after saying "Your moderator is wrong" and "Your moderators screwed up".

There are [to date] 6 'participants' in this thread.  5 are saying you are wrong and the 6th is you.  That in itself should be an indicator of your error....;)

Good Grief, your level of ignorant is astonishing. Congratulation on promoting yourself from whinning stuckup little princess to throwing temper trantrum. You shifted the entire argument from claiming your right that altering, editing, modifying, or improving upon someone else works is okay and you should taking up some credit for it to shotgunning the argument in attempting to find a hole where your opponent couldn't answer and dig into it to win the argument just for the sake of argument. You start making this personal against Airmaster. This doesn't look healthy at all.

I hope you been doing this because you been frustrated and lashing out without logical thinking beacuse your modified creation of Airmaster, and Omnibus's ship been removed from the Steam Workshop and render yourself unable to use it on your own anymore. Admit it and walk away. Stardock staff decision is final and you should respect that to some degree. Don't digging this hole deeper than it should be.

Go Back to law school sonny boy, Just because your interpretation of the law fits your world does not make it so. You have no patents on those ships, you did n not create or own the original intellectual property you used to create those ships from. and no matter how loadly you shout it from the space stations. you do not have copy rights to any of those ships.

 I have spent more than enough of my valuable  time on ignorant people like you. I won't use your coveted ships. But please do the right thing and keep your so called designs off the steam workshop and mark them for your personal use or click the friends only box so they don't come up and other players believe they can be used without penalty or having to deal with your ignorance.
