Top edge of maximized windows shows the hand grabber

ModernMix version 1.12

The top edge of a desktop maximized W8.1 app window displays the hand grabber.  Using the grabber to close the window doesn't actually close the app and doesn't appear to serve any purpose.

Is there a way to turn-off this hand grabber or is this a bug?
