Iniquity

I wasn't going to post a sneak preview for this.  Originally I had planned to just skin it the way I saw fit, and let the chips fall where they will, but I'm over half way through and I want to know NOW before I get too much further into it, whether I'm going to need to re-design something due to the fact that I don't have the rights to certain images.

I've used some Photoshop custom shapes I got from DeviantArt, (of which I have a text file I'm keeping so I can give proper credit when I upload) but I've been made aware that just because I give credit to the author of a certain resource on DA, does not necessarily mean that THAT author has the rights to those images.  For example, there is a set of "assorted logos" but there is no permission from the corporations that hold the copyrights to those logos giving permission to the uploader to make those images available.  Example here:  http://richardperkins.deviantart.com/art/Assorted-Logos-91198824

So, please let me know now if you see anything here that you believe to be a copyright violation.  Thank you.

When/if ever in doubt, ask for permission.

Good suggestion. Snowy...how does that apply to creating Suites? *doc is not hijacking.

Karen... that's just great!

That's difficult to do if  I don't know whether something is a logo or not.  I originally had a bat on top of the start menu, which was a custom shape I got from DeviantArt, and after I posted a teaser screen shot, Xiandi told me it was the logo for Nepetier Pub and I needed their permission to use it.  Since I didn't know of the existence of Nepetier Pub, and the DA uploader of the Photoshop Custom Shape didn't state it was a logo, I was totally ignorant of the copyright on it, or who held the copyright.  I want to make sure, before I go any further in the creation of this, that there isn't anything else that wasn't properly labeled as a logo from the resources I got from DA.

I personally like what you have shown here k10w3:thumbsup:    I'm sure the finished theme will be great.

Doc, if you are making reference to the Theme Manager Suites that I do I don't believe there is a problem as I'm not taking skins or graphics and changing them.  I collect or download themed skins that have been made with the original theme skinners permission.  I sometimes add non-themed skins to help fill out a theme to make a suite.  No work or skin is ever represented as mine.  All links in the Suite go back to the original skinners.  If you weren't refering to the TM Suites, then never mind. :sun:

Sorry, just answering Doc's question.

I'm not trying to be a smart ass here, but one way to insure no copyright issues is to create all the images yourself.

I was, Philly and really should have recommended karmat ask you. d'oh. There seem to be so many rules and wouldn't want to give someone else a bum steer....

I'll pm karmat and let her know. Thanx, bud! :)

That is actually the only way to be sure.

Third party sources will always be suspect at best.

If you don't even 'borrow' you can never be accused of 'stealing'....;)

Well, I guess it doesn't matter now.  I upgraded to Windows 7 and this skin is a hideous mess with the upgrade.  I think I'm throwing the towel in on creating anymore skins.  It was so beautiful in Vista, and I was so pleased, and now it's just awful.  I think I need to go self medicate and cry in a corner somewhere.

k10 if I may? Please take a look at the Iniquity preview (#44) from your thread locked out to this preview... the original one is so much more artistic than this one...the first one I gotta have!!! This one not so much... Just my 2 cents cuz it would be a shame if it didnt get finished...

It would be a shame if you didn't see this one through. Listen to Uncle Skinhit.

That one will get thrown out on moderation, Jack, because the bat apparently is an official logo of Nepetier Pub (I didn't even know such a place existed when I started that -- I was just using a custom shape I got from DA and I applied different styles and added things to it -- then I got informed I couldn't use it, because it was a protected image).

This is just not fun anymore.  It's gotten political and risky, and with the upgrade I'm just totally lost on putting the thing together.  I'm too discouraged.  I need to find a new hobby/drug.  This one is farked.

please dont give up karen, any brushes i am using, i am giving links back to the creators, as i mentioned to you earlier, this solves the problem. (or so i was told)

k10w3 .... it's all about 'research'....checking into the bona-fides of sources of images/content you wish to use for whatever.

Skinning is no different to any other sort of graphic production.  As long as sources are verified and permissions granted [if needed] then you are free to create.

Nothing 'got political'.  It has always been that way...;)

Karen I don’t mean to sound stupid (for me it just comes naturally) but have you contacted Nepetier Pub to see if you can get permission?

I agree with Skinit, it looks like an awesome skin!

Listen to Uncle Jafo, Karen. He really is "The Voice of Reason". I understand your upset...and frustration. Having just moved and updated to 7 and lost a lot of stuff.

It isn't 'political'... it's a 'property rights' thing, a legal thing. Keep doing your thing...and "make your own images" doesn't really solve the problem...as what one honestly creates is just as vulnerable as a 'borrowed' image.

In truth, how does one differentiate between a quasi-remembered image vs. one an 'original' one? How can one be certain as to 'originality'? In fact you can only be honest and give it your best shot.

:) :sun:  To a very sweet person and artist!

There's a problem with that -- the pub is in the Slovakia, and I don't speak Slovakian.

I'm just going to gloomy for a few weeks, probably eat too much chocolate, sleep too much, play a bunch of Mahjoong...yell at the cat, throw things.  Eventually the itch will come back and I'll open up my graphics program again.

Yeah you could do that or you could get determined, create a killer skin and end up feeling good about the whole thing. I’m still not convinced it’s possible to eat too much chocolate though.

Good because it looks good especially black leather backgrounds.

Just don't throw chocolate at the cat, feline chocolate poisoning is not good.

That cat is picky about food anyway -- the only human food he's ever touched was the mayonnaise on a piece of bread my son had out to make a sandwich with; and since then, neither one of them has touched mayonnaise.  For some reason the cat think's the dog's food is the greatest.  Keeps me on my toes, since the dog is food aggressive, weighs 80 lbs, is a pitbull, and the cat only weighs 5 lbs.  Cat must be an adrenaline junkie is all I can think of.
