Theme reverting to "win 98" style theme after reboot

I've been trying to get an windows xp theme working which all goes fine until I reboot my computer. When ever I reboot it removes the theme is set and goes back to the grey win 98 style theme.

Anyone know how I can resolve this? I've googled around but I can't find anything.
