Amazon goes after New York state over new taxes

Amazon suing New York state over new sales tax law

Amazon.com Inc has sued the state of New York, challenging a new statute requiring Internet retailers based elsewhere to collect New York sales taxes.
End of quote

I love this move and hope that Amazon cleans up here.  Get this b.s. tax tossed permanently and send the message to any other states that might be considering passage of a similar tax that it would be a stupid move to even consider.

I feel for the businesses based in these states in their apparent competitive disadvantage against the 'big, evil' Amazon.com but there is a better solution entirely: get these states to eliminate their sales taxes or at least reduce those taxes and other fees so that these businesses can compete on a more even playing field.  If the costs of doing business in the states go down the businesses should be able to offer similar pricing and competition goes to work for everyone to benefit from.

Too bad New York is probably the tip of the iceberg when it comes to passing these anti-competitive tax laws.

Technically, you are required by each state to pay sales taxes on any purchases not automatically collected by the retailer. And you have the right to demand a refund of taxes paid to other states that you do not reside in.

Technically.

But very few people do (I do not). Virginia went so far a few years ago as to include a form for you to "submit" your taxes on.

NY is going to lose. The reason that internet retailers do not collect taxes is that they are not in that state, and only the feds control interstate commerce (and they have declined to tax it at this point in time). But this is a case that Cacto needs to see. For if they do collect any taxes, when they are over ruled by SCOTUS, those taxes are not going to go back to the tax payer. They simply will not be lawfully (note the word) able to collect any new taxes.
